General Terms and Conditions for Consumers (as of: November 2024)
1. Scope
These General Terms and Conditions (GTC) apply to all deliveries from WESTHYPE® (Registered Trademark of Invesita e.U.) to consumers.
A consumer is any natural person who concludes a legal transaction for a purpose that cannot be predominantly attributed to either their commercial or independent professional activity.
2. Contracting Party
The purchase agreement is concluded with Invesita e.U.
2.1 Contract Language
The contract language is German and English.
2.2 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation for the customer to submit an offer. The customer's order constitutes an offer. Once the order has been received by us, the customer will be notified of its receipt via the email address provided. This notification on our part does not yet constitute acceptance of the customer's offer. A contract is only concluded upon our acceptance. Acceptance occurs with the shipment of the ordered goods. Our confirmation of receipt of the customer's order by email does not constitute acceptance of the offer on our part.
2. Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., by email) of your decision to withdraw from this contract. To meet the deadline, it is sufficient that you send the notification before the withdrawal period expires.

2.2. Consequences of Withdrawal
If you withdraw from this contract, we must repay you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days from the day on which we received your notification of withdrawal.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods.
You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of the withdrawal.

2.3. Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts for:

Goods manufactured according to customer specifications or clearly tailored to personal needs

Goods that have been inseparably mixed with other goods after delivery
2.4. Compensation for Value
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their nature, properties, and functionality.
3. Prices and Shipping Costs
All prices are total prices. They include all taxes, including VAT, unless these are separately stated. Shipping costs will be clearly communicated to you in the shopping cart system during checkout.
4. Destination Country
The online shop is designed for Germany, Austria, Belgium, Croatia, Netherlands, Poland, Portugal, Romania, Sweden, Slovenia, Slovakia, Czech Republic, Denmark, Hungary, Italy, and France. We only deliver to shipping addresses in these countries.
5. Payment
Payment can be made by Paypal, Eps, Maestro, Visacard, Mastercard, Klarna, Google Pay, Apple Pay, or bank transfer. If you select bank transfer as the payment method, we will provide you with our bank details in the order confirmation.
6. Retention of Title
The goods remain our property until full payment has been received.
7. Dispute Resolution
The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for out-of-court resolution of disputes concerning contractual obligations arising from online purchase agreements. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
